On that date Anne, whose maiden name may possibly have been Duncombe, transferred cattle from the estate of Andrew to their two young sons. She stated that because Andrew had also received land from his father he should only have 1/3 of the cattle, while Thomas should have 2/3. This transfer was made just before she remarried to James Toone, apparently to protect her children's inheritance. Anne and James had at least six children together. James Toone died before June 6th, 1777, in his will he named Thomas and Andrew Dew and left them one mare only if his daughter Anne died before coming of age but then all the increase of the horse to go to the sons of James.
Thomas' mother married for the third and final time about 1679 to Dominick Rice. That same year Thomas purchased 200 acres from his new step-father in the northern part of Rappahannock County. In 1683 his brother Andrew transferred a 100 acre tract of a larger patent that had been claimed by their father. Dominick Rice died before March of 1685, on that date his will was probated. He left Thomas 20 shillings to buy a ring.
Thomas' mother wrote a will on January 8th, 1685. She named Thomas as her executor and to "to have all my children to him during their minority." Anne's will was probated on November 3rd, 1686. After her death Thomas submitted a statement expressing that his mother had wanted to add additional bequests to her will for her youngest child, Stephen Rice.
Thomas married to Elizabeth Barber before 1688 in North Farnham Parish, Richmond County. Thomas and Elizabeth had at least four children. Elizabeth died before 1703 when Thomas remarried to Jane Billington, widow of John Barker but did not have any more children.
In 1705 in Richmond County Court Thomas filed a deed of gift to his brother Andrew and returned to land that Andrew had given to him in 1779 as well as giving Andrew the 200 acres that he had purchased from Dominick Rice that same year.
Thomas wrote his will on December 23rd, 1708 and it was proven February 2nd, 1709 in Richmond County Court. He named his current wife and her children William and Elizabeth in addition to naming daughters Anne, Mary and Elizabeth. He named his son Thomas as executor and left him an Indian woman and a gun. He left daughter Elizabeth a white mare, a feather bed, a gold ring and a small trunk. His brother Andrew served as a witness.
